The videos showed M. Eddie Dillon picking up and carrying his 3- year-old son, lifting a small power mower off the back of his truck and mowing the lawn. But they weren't home movies - the videos were presented to members of the Oklahoma Workers' Compensation Court as evidence that Dillon was not entitled to permanent total disability benefits.
The court had uncontroverted evidence that as of October 2005, combined injuries spanning back to 1986 had left Dillon with an 86.75-percent permanent partial disability. But in December 2005, Dillion filed a Form 3-E seeking permanent total disability benefits from his employer, Sutton Tractor Inc., arising from cumulative disabilities culminating in one final injury in September 2003.See the full content of this document
